FDA sues six e-cigarette makers for illegal sales 2022-10-20
Six e-cigarette manufacturers are illegally making, selling, and distributing their products, despite previous warnings about legal repercussions, according to federal regulators. The U.S. Department of Justice (DOJ) and the Food and Drug Administration (FDA) filed complaints asking federal courts for permanent injunctions to block sales. In a news release, the federal agencies said the cases are the first time they have gone to court seeking enforcement through the federal Food, Drug, and Cosmetic Act`s (FD&C Act) premarket review requirements for new tobacco products. The enforcement actions "represent a significant step for the FDA in preventing tobacco product manufacturers from violating the law," Brian King, PhD, MPH, director of the FDA's Center for Tobacco Products, said in a news release. "We will not stand by as manufacturers repeatedly break the law, especially after being afforded multiple opportunities to comply." The federal agencies claimed the defendants made and sold new tobacco products without first obtaining marketing authorization from the FDA. U.S. cigarette maker Altria Group Inc on Wednesday said industry peer Philip Morris International Inc (PMI) (PM.N) has agreed to pay it $2.7 billion for the exclusive right to sell IQOS heated tobacco products in the United States. Altria in a statement said it has already received $1.0 billion from PMI and will receive the remainder by July 2023. The company had been selling IQOS in the United States through unit PM USA in partnership with the smoke-free product's developer PMI under an agreement that was set to expire in 2024. "Upon achieving additional milestones, PM USA had the option to renew for an additional five-year term through April 2029. We believe that PM USA met each of these milestones, but PMI disagreed with our position," Altria said. IQOS devices differ from traditional combustible cigarettes in that they heat tobacco-filled sticks wrapped in paper, generating an aerosol that contains nicotine. The Korea Electronic Cigarette Association (KECA), a group of about 4,000 e-cigarettes vendors, said it has filed a lawsuit against the Ministry of Health and Welfare (MOHW) and the Korea Disease Control and Prevention Agency (KDCA), demanding the government correct misguided information about e-cigarettes. The Korea Electronic Cigarette Association has filed a lawsuit against the government for allegedly causing financial damage to e-cigarette-related small business owners with incorrect information. In 2019, the U.S. Centers for Disease Control and Prevention (CDC) said there were 530 confirmed severe lung diseases, and eight deaths in the U.S. related to the use of liquid-type e-cigarettes, which led to the FDA to ban e-cigarettes. "However, at the time of the announcement of the MOHW`s recommendation, there was only one suspected case of lung damage in Korea, and even the suspected case came from a person who smoked tobacco," the KECA said.

Vaping is substantially less harmful than smoking, according to a major review of nicotine products, but action is needed to tackle the sharp rise in e-cigarette use among children. Researchers at King`s College London said smokers who switched to vaping would experience a "substantial reduction" in their exposure to toxic substances that cause cancer, lung and cardiovascular disease, but they strongly urged non-smokers not to take up either habit. Arkansas Attorney General Leslie Rutledge announced Wednesday a $438.5 million agreement in principle between JUUL Labs and 34 states and territories resolving a two-year investigation into the e-cigarette manufacturer`s marketing and sales practices. Arkansas will receive $13,553,391.88 over five years as part of the agreement. In addition to the financial terms, the settlement would force JUUL to comply with a series of strict injunctive terms severely limiting their marketing and sales practices. "It is the fault of companies like JUUL who spread misinformation and incentivized youth to buy vaping products that created this epidemic that continues to be a prevalent problem in our schools and neighborhoods," said Rutledge. There has been a rise in the number of school children in England vaping, with 9% of 11 to 15 year olds currently using e-cigarettes, up from 6% in 2018, and over half (57%) of regular e-cigarette users are purchasing them from shops, according to the latest data from NHS Digital, the national information and technology partner for the health and care system. The Smoking, Drinking and Drug Use among Young People in England, 2021 report found that 61% of regular e-cigarette users said other people gave them e-cigarettes, the most common of whom were friends (45%).
