New Brunswick Court of Appeal maintains ban on sale of flavoured e-cigarettes 2022-05-16
The New Brunswick Court of Appeal has upheld a lower court decision not to suspend the province's ban on the sale of flavoured e-cigarettes. Last September, the province banned all e-cigarette flavours except for tobacco, but a vape store and five individuals wanted sales to resume pending a full court challenge of the legislation. They argued that vape stores were suffering financially because of the law, and that without flavoured e-cigarette options, people trying to quit smoking would go back to smoking tobacco, which poses a greater health risk. The ruling from the Court of Queen's Bench in March said the government's intent with the legislation was to protect the health of residents, particularly young people. In his one-line decision Thursday, Court of Appeal Justice Brad Green said the motion for leave to appeal is dismissed. No date has been set for the full constitutional challenge.
Hong Kong police made their first arrests under a law banning the sale of electronic cigarettes after two men were allegedly caught with the items on Wednesday. The suspects, aged 28 and 31, remained in custody as of Thursday. They were being held on suspicion of selling and possessing a poison in Part 1 of the Pharmacy and Poisons Regulations, as well as selling alternative smoking products. The law, which came into effect on Saturday, bans the import, sale and manufacture of electronic cigarettes, heated tobacco products and herbal cigarettes, with offenders subject to a maximum fine of HK$50,000 (US$6,370) and six months` imprisonment. Aspire Global, a Shenzhen-based e-cigarette maker that recently branched out into cannabis vaping, has applied to US regulators to pull out of a proposed listing that would have raised US$135 million as tighter rules at home make fundraising more difficult. The company filed a withdrawal request to the Securities and Exchange Commission on Monday, without providing a reason for the decision in its filing. It had originally planned to sell 15 million shares at US$7 to US$9 each, and had applied to trade on the Nasdaq exchange under the ticker "ASPG". Aspire kicked off its Nasdaq listing application last June, and updated its draft prospectus in January this year. Its withdrawal comes as recent rules introduced in China make expansion and distribution more challenging for e-cigarette manufacturers. China Publishes Final GB Standard on E-Cigarettes: The Basis for Product Compliance 2022-05-11
Since we reported in December 2021 on some significant developments in China`s regulation of e-cigarettes (including the draft national standard on e-cigarettes) as well as in March 2022 on the finalized Management Rules for E-Cigarettes, China`s State Tobacco Monopoly Administration (STMA), also referred to as China National Tobacco Corporation (CNTC), has not only released the national Standard GB 41700-2022 on Electronic Cigarettes but also published further regulations detailing the procedure and requirements for licensing, technical review, etc. In the coming weeks, we will publish a series of articles summarizing these new regulations. This article will first focus on GB 41700-2022. We should note that, according to the Management Rules for E-cigarettes, e-cigarettes for export only are not necessarily required to comply with GB 41700-2022; rather, they must comply with the destination country`s laws, regulations, and standards. When the destination country has no relevant laws or standards, e-cigarettes only for export must comply with China`s laws and standards, which we understand will include GB 41700-2022. DENVER - The nicotine landscape in Colorado is likely to change in the near future, but how much depends on what lawmakers do in the final days of this year`s legislative session. Late last month, the U.S. Food and Drug Administration proposed banning menthol in cigarettes and all non-tobacco flavors in cigars. A bill in the Colorado legislature would go further, prohibiting retailers from selling any tobacco product that`s flavored, and outlawing products made with lab-created nicotine. That wider definition would include e-cigarette liquid and most products, other than "premium cigars" and hookah tobacco. Both proposed bans would apply to manufacturers, distributors and retailers. Possession and use of flavored tobacco products wouldn`t be a crime. There`s widespread agreement in the public health community that banning flavors from cigarettes and cigars would save lives, but applying the same rules to e-cigarettes is more controversial. Carrie Lam Cheng Yuet-ngor`s term as chief executive has been marked by tumultuous events. But in terms of public health, a decade or two from now she may also be remembered for her role in the ban on the import and sale of e-cigarettes and other alternatives that has just become law. The ban, first proposed seven years ago, was watered down in 2018 to the permissive regulation that applies to tobacco products. Opposition to the backdown from medical and education authorities prompted Lam to switch to proposing the full ban in her policy address that year. It took lawmakers until last October to pass legislation without exemptions and concessions of one kind or another. Evidence of the effect on consumption of e-cigarettes and the like is that the law has forced some shops selling these products to close. The most persuasive argument against outlawing the [new tobacco products" was that they were a not so harmful alternative that helped nicotine addicts quit smoking tobacco and perhaps stop altogether. But health minister Sophia Chan Siu-chee said many surveys that supported it were sponsored by tobacco companies. According to the 2018-2019 Canadian Student Tobacco, Alcohol, and Drugs Survey that noted e-cigarette use within 30 days prior to reporting, prevalence among teenagers between school grades 7 and 12 was 20%, doubling the prevalence found in the 2017-2018 survey. Further, 90% of teenagers consumed products containing nicotine. Prevalence of ever use among teenagers has been reported to be lower in Asian countries, with 3.5% reporting past use in Japan and 10.1% in South Korea in recent years. However, vaping is not an issue that started very recently. Between 2010 and 2014, e-cigarette use among teenagers in Eastern and Central Europe increased by 24.4%, and 43.7% reported previously experimenting with e-cigarettes. Additionally, while data in South America are limited, a 2015 study in Brazil found 2.1% of teenagers had ever tried e-cigarettes, and a 2014-2015 study in Argentina reported a 5.2% rise in prevalence. When developing clinical preventions, the authors found that few medical practitioners screen patients for e-cigarette use in primary care practices. In a sample of 776 US practitioners, a study showed prevalence of screening for e-cigarettes was only 14%, compared with 86% screening for traditional smoking. The ACT Government could soon have tougher protections to stop the sale of both e-cigarettes and vaping products to minors.Retailers of e-cigarettes and vaping products could soon be targeted by the ACT Government, which has proposed new legislation that would allow it to send minors in to attempt to purchase the items in a kind of "sting operation". Compliance checks can currently be conducted for tobacco products, but there isn`t any framework to help identify retailers selling `vapes` to minors. The change is part of a suite of reforms proposed by Minister for Health Rachel Stephen-Smith to regulate the sales of these items, which are becoming increasingly popular with young people. Electronic cigarette use had neutral impact on cardiovascular events when used alone, but dual use with conventional tobacco cigarettes wasn't any less risky than only smoking, a study showed. Exclusive use of e-cigarettes was on par with no use for overall risk of developing any cardiovascular disease (adjusted HR 1.00, 95% CI 0.69-1.45) and lower risk than only smoking (aHR 0.66, 95% CI 0.46-0.94), Andrew C. Stokes, PhD, of Boston University School of Public Health, and colleagues reported in Circulation. For major events, exclusive e-cigarette use showed a nonsignificant trend for 35% higher risk than not smoking or vaping (aHR 1.35, 95% CI 0.75-2.42). And that combined risk of myocardial infarction, heart failure, or stroke with exclusive e-cigarette use wasn't significantly lower than with smoking alone. Dual users were at significantly higher risk than nonusers for both sets of outcomes: a relative 54% greater incidence of any cardiovascular disease and 2.08-fold higher risk for the major events. That risk from combined vaping and smoking did not differ from exclusive smokers for either outcome (aHR 1.01, 95% CI 0.81-1.26, and aHR 0.94, 95% CI 0.65-1.36, respectively). SHANGHAI, April 25 - China's tobacco regulator on Monday issued draft rules to strictly control e-cigarette production, as it tightened oversight of the industry. The State Tobacco Monopoly Administration said it would "reasonably" control the scale of e-cigarette production capacity to prevent overcapacity. Foreign investment in the retail of e-cigarette products would be banned, the regulator said, and it would review foreign investment in production, requiring e-cigarette firms that want to list in China or abroad to obtain pre-approval.

Young people who try vaping are more likely to later start smoking – but a new analysis of trends in nicotine use in England suggests that the so-called gateway theory of vaping isn`t the explanation. The real reason for the link could be that teens who start vaping are the same ones who are likely to try smoking, regardless of whether they ever have an e-cigarette. Vaping is much less harmful for people`s health than smoking, causing about 95 per cent less damage, according to an estimate by Public Health England. On March 11, 2022, STMA announced the publication of the final Management Rules for E-cigarettes, which will take effect starting May 1, 2022. At the same time, the second draft GB standard on e-cigarettes also was published for comment by March 17. We summarize below some notable changes in the final Management Rules. The final version deletes the definition for [e-cigarettes," which was [an electronic delivery product that produces nicotine-containing aerosol for human inhalation." Since the Management Rules state that e-cigarettes must comply with the mandatory national standard, one should now refer to the GB standard on e-cigarettes for the definition of e-cigarettes. Notably, the second draft GB standard removes [nicotine-containing" from the definition of e-cigarettes but at the same time adds a requirement that e-atomization materials must contain nicotine. Since the GB standard is still under development, we will continue to keep a close eye on how the potential change to the definition for e-cigarettes would impact the application scope of the Management Rules. The final Management Rules remove product registration requirements. However, e-cigarette products, including imported products, still must pass the technical review by STMA before being marketed in China. It, therefore, appears that there has been a loosening of the regulatory requirements in this regard since a registration process is typically more onerous than a technical review. However, the details of what the technical review process will look like remain unclear.
